AFTER A WORK ACCIDENT OR DISEASE, YOU MUST ACT IMMEDIATELY!

Workers' compensation benefits mean nothing if you do not report your accident or disease to your employer and file your claim within the proper amount of time. Your failure to do so can result in your claim being dismissed without benefits.

Don't wait for your employer or their workers' compensation insurance company to "handle the paperwork" for you. Under Maryland law, this is your responsibility, not theirs!.

Your failure to follow these time rules can result in your loss of all workers' compensation benefits.

  • Work accidents must be reported to your employer within 10 days of the injury, and workers' compensation claims must be formally filed with the Maryland state agency that handles work injury claims, the 'Workers' Compensation Commission', within 60 days of the accident.
  • Occupational diseases must be reported within one year of when you know, or have reason to believe, that your job was responsible for the illness, and the claim must be formally filed within two years of disablement or death from the occupational disease.

Two months or two years may seem like a lot of time, but when you are injured and in pain, your main concern should be focusing on your recovery.

Even though some circumstances exist where these strict deadlines can be extended or waived, these rules are complicated and need to be proved at a hearing. You put your right to get benefits at risk when you fail to report your injury and file your claim as soon as possible after you are hurt.

These are some of the crucial steps that you must take in order to receive maximum compensation for your work injury or work disease, and to prevent the complete loss of benefits.
